Kiefer Sutherland allegedly punched and attempted to choke the Uber driver he had an altercation with, ultimately leading to his arrest, according to the Daily Mail.

The incident, which occurred on January 12, saw the 59-year-old actor get into a confrontation with a rideshare driver near Hollywood, around Sunset Boulevard and Fairfax Avenue.

The driver then fled in an attempt to escape Sutherland and while there, he called 911 to report the situation.

According to ABC Newseyewitnesses claim the “Designated Survivor” star appeared to be “under the influence” as he is suspected of assaulting the driver and getting into the vehicle without their consent.

Authorities have reportedly seen footage from the vehicle’s dashboard camera, which may have captured the entire incident, as the investigation continues.

The actor faces up to three years in prison

Authorities confirm that no injuries were sustained that would have required immediate medical attention, and following the incident, Sutherland was taken into custody on suspicion of criminal threats, a charge that can result in up to 3 years in state prison under California law.

He has since been released after posting $50,000 bail. Sutherland has not yet been charged in connection with the incident, as officials with the Los Angeles County District Attorney’s Office explained that the LAPD has not yet filed a complaint with them.

However, it may not be long before the Emmy winner faces court, as DA sources say they expect charges to be filed next month, likely after his February 2 court appearance.

This is not Sutherland’s first run-in with the law, as he has been arrested several times in the past, including for offenses related to drunk driving. He racked up approximately 4 drunk driving convictions between 1980 and 2008, the latter of which resulted in a 48-day jail sentence.

For that incident, he initially received a 30-day sentence after pleading no contest in October 2007 to driving under the influence. However, the court added an additional 18 days after Sutherland violated the probation he was under for a similar offense in 2004.

After his eventual release at the time, an LAPD official said People Magazine that he “looked happy to be out” of prison and that he was a model inmate behind bars.

“He was very humble, he never complained,” the officer said. “He didn’t give us any trouble.”

The actor also expressed remorse over his misgivings and said he was “very disappointed” in himself for the “lack of judgment” he showed during the incident.

“I am deeply sorry for the disappointment and distress this has caused my family, friends and colleagues at 24 and 20th Century Fox,” Sutherland said.

He added: “I appreciate the support and attention that has been given to me over the last few weeks, both personally and professionally.”

Sutherland’s career appears to have taken a downward spiral after playing several disappointing roles over the past decade.

His latest role as Bradley Mack in “Tinsel Town” failed to achieve the success he achieved playing sniper Jack Bauer in “24,” or U.S. President Tom Kirkman in “Designated Survivor,” and sources say that’s because he’s “struggling to find roles” that mean anything to him.
